1. PARTIES

This Agreement www.doxagon.com, which carries out the activities of the website İçerenköy Mah., Üsküdar-İçerenköy Yolu Cad. No:10, Kat:2, VIP Centre, Ataşehir, Istanbul, BIS ÇÖZÜM BİLGİSAYAR VE INTEGRATION HİZMETLERİ VE TİC. A.Ş. (hereinafter referred to as “BIS”) and the internet user who is a member of the website www.doxagon.com (“Member”).

2. SUBJECT OF THE CONTRACT

The subject of this Agreement is to determine the terms of the Member’s use of the website www.doxagon.com.

3. RIGHTS AND OBLIGATİONS OF THE PARTIES

In order to gain membership status, the user who wants to become a Member must approve this Membership Agreement on the Website and fill in the information requested here with correct and up-to-date information. The user who wants to become a member shall be required to have completed the age of 18 (eighteen). Upon completion of the approval process and notification to the Member, the Membership status starts and thus the Member becomes subject to the rights and obligations specified in this Membership Agreement and the relevant parts of the Website. The Member who fails to provide accurate and up-to-date information when filling out the said Membership Agreement is personally liable for all damages that may arise for this reason.

 

3.1. The Member declares and undertakes that the personal and other information provided while becoming a member of the website www.doxagon.com is correct in the eyes of the law, and that BIS will fully and immediately compensate all damages that BIS may incur due to the untruthfulness of this information.

 

3.2. The member cannot give the password given to him/her by BIS and the password to be created by him/her to other persons or organisations, the member’s right to use the password in question belongs to himself/herself. Due to all liability that may arise against BIS due to the member’s breach of this obligation and/or against all claims and demands that may be asserted against BIS by third parties or competent authorities, BIS reserves all kinds of compensation and other claims arising from such unauthorised use.

 

3.3. The Member accepts and undertakes from the beginning to comply with the provisions of the legal legislation and not to violate them while using the website www.doxagon.com. Otherwise, all legal and criminal liabilities that may arise shall be fully and exclusively binding on the member.

 

3.4. The member may not use the www.doxagon.com website in any way that disrupts public order, violates public morality, disturbs and harasses others, for an illegal purpose, infringes the intellectual and copyright rights of others. In addition, the member cannot engage in activities (spam, virus, trojan horse, etc.) and transactions that prevent or make it difficult for others to use the services.

3.5. BIS shall not be responsible for the reading of member data by unauthorised persons and any damage to member software and data. The Member agrees in advance not to claim compensation from BIS for any damages that may be incurred due to the use of the www.doxagon.com website.

 

3.6. The Member agrees not to access or use the data of other users of the www.doxagon.com website without authorisation. Otherwise, the legal and criminal liabilities arising from this belong entirely to the member.

 

3.7. The member who violates one or more of the articles listed in this membership agreement is personally criminally and legally responsible for this violation and will keep BIS free from the legal and criminal consequences of these violations. In addition; due to this breach, if the incident is referred to the legal field, BIS reserves the right to claim compensation against the member for non-compliance with the membership agreement.

 

3.8. BIS always has the right to unilaterally delete the membership of the member, delete the files, documents and information belonging to the customer. The member accepts this saving in advance. In this case, BIS has no responsibility.

 

3.9. The software and design of the www.doxagon.com website are the property of BIS, and the copyright and/or other intellectual property rights related to them are protected by the relevant laws, and they cannot be used, acquired and changed by the member without permission. Other companies and products mentioned on this website are trademarks of their respective owners and are also protected by intellectual property rights.

 

3.11. BIS may use the personal information of the members in order to provide better service to its users, to improve its products and services, to facilitate the use of the site, and to work on the special preferences and interests of its users. BIS reserves the right to keep a record of the member’s movements on the www.doxagon.com website.

 

3.12. The person who is a member of BIS declares and accepts that he / she allows all companies that are affiliates of BIS, all brands of these companies and all companies and brands with which he / she cooperates to offer him / her product and service promotions, advertisements, campaigns, advantages, surveys and other customer satisfaction applications, and to store and share this membership information within the scope of the applications in force and / or to be put into force. The Member declares and accepts that he/she allows his/her personal information that he/she has provided in the past and/or will provide in the future while becoming a member of BIS and/or by other means to be collected for the above purposes, to be shared with all companies affiliated with BIS, to be used and archived by such companies. Unless the member declares otherwise, the member declares and accepts that he/she allows the data to be collected, shared with the companies in question, used and archived by them when his/her membership expires. Unless the Member declares otherwise, the Member declares and accepts that he/she allows BIS and all affiliated companies to contact him/her via internet, telephone, SMS, etc. communication channels. 3.13. BIS may disclose the personal information of the member when requested as a legal obligation or when it believes in good faith that it is necessary (a) to comply with legal requirements or to comply with legal proceedings notified; (b) to protect and defend the rights and property of the BIS website family.

 

3.14. BIS has taken measures to ensure that the BIS website is free of viruses and similar software. However, in order to ensure ultimate security, it is recommended that the user procure their own virus protection system and provide the necessary protection. In this context, by accessing the website www.doxagon.com, the member is deemed to have accepted that he/she is responsible for all errors that may occur in his/her software and operating systems and their direct or indirect consequences.The Member shall not use the Website in a manner contrary to law and morality, especially in the cases listed below.

3.16. BIS may change, update or cancel the terms of the membership agreement at any time without the need for prior notice and / or warning in any form and manner. Any amended, updated or cancelled provision shall be effective for all members on the date of publication.

 

3.17. In accordance with this membership agreement, BIS has the authority to send information mails to the e-mail addresses of its members registered with it and / or information SMS to their mobile phones, and the member shall be deemed to have accepted the sending of information mails to the e-mail address and/or information SMS to the mobile phone upon approval of this membership agreement.

4. TERMINATION OF THE CONTRACT

This agreement will remain in force until the member cancels his/her membership or his/her membership is cancelled. BIS may unilaterally terminate the agreement by cancelling the membership of the member in case the member violates any provision of the membership agreement. In the event of termination of the Agreement regarding the products purchased by the Customer before the membership period is completed, the fees paid to BIS will not be refunded and the Customer’s access to the system will be closed at the end of 15 calendar days. The Customer is solely responsible for backing up the Customer’s information and BIS has the right to delete the Customer’s records at the end of maximum 15 calendar days.

5. DISPUTE RESOLUTION

Istanbul Anatolian Courts of Justice and Execution Offices are authorised for disputes regarding this agreement.

6. ENFORCEMENT

The member’s membership registration means that the member has read all the articles in the membership agreement and accepts the articles in the membership agreement. This Agreement was concluded at the time the member became a member and entered into force mutually.
